These Terms & Conditions (“Terms”) govern your use of theivykeep.com (the “Site”) and purchases made from The Ivy Keep (“The Ivy Keep,” “we,” or “us”).
By using the Site or placing an order, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.
Eligibility
You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order.
By placing an order, you confirm that the information you provide is accurate and complete.
Your account
You may sign in to your account using a one-time code sent to your email address. We do not require or store customer account passwords.
You are responsible for maintaining the security of your email account. Please contact us promptly if you believe someone has accessed your Ivy Keep account without permission.
Orders
Placing an order is an offer to purchase the objects in your order. We accept your order when we confirm it by email.
We may refuse or cancel an order for reasons including limited availability, errors in pricing or product information, inability to fulfill the order, or suspected fraud or misuse of the Site.
If we cancel an order after payment has been processed, we will issue a full refund to your original payment method.
Prices & payment
Prices are shown in U.S. dollars. Shipping charges and applicable taxes are shown at checkout.
The price you pay is the price displayed at checkout when you place your order. We may change prices at any time, but price changes will not affect orders already placed.
If an object is listed at an incorrect price because of an error, we may cancel the affected order and issue a full refund.
Payment is collected when you place your order and is processed securely by Stripe. The Ivy Keep does not see or store your complete payment-card information.
Shipping & delivery
The Ivy Keep currently ships within the United States only.
Orders are typically processed within three (3) business days after they are placed. Processing and delivery times are separate.
Delivery times are estimates and are not guaranteed. Delays may occur because of carriers, weather, holidays, or other circumstances outside our reasonable control.
Please make sure your shipping address is accurate when placing your order. If you need to request an address correction, you may do so through your account before the order ships.
Tracking information will be emailed to you when your order ships.

Cancellations, returns & refunds
Orders may be cancelled before they ship.
Unused objects in their original condition may be eligible for return within 10 days of delivery, subject to our Returns & Refunds Policy.
Items designated as final sale are not eligible for return or refund except where required by law.
Please see our Returns & Refunds Policy for eligibility, return procedures, damaged or incorrect items, return shipping costs, and refund timing. That policy forms part of these Terms.
Text messages (SMS)
If you choose to receive text messages from The Ivy Keep, you may receive recurring automated marketing text messages.
You will receive text messages only if you provide your mobile number and affirmatively agree to receive them. Consent to receive text messages is not a condition of purchase. Messages are sent through Intuit Mailchimp.
Message frequency varies. Message and data rates may apply.
To stop receiving text messages, reply STOP. You may receive a final message confirming that you have been unsubscribed. To receive messages again, you must opt in again.

Wireless carriers are not responsible for delayed or undelivered messages.
By opting in, you confirm that you are the account holder for the mobile number provided or have the account holder's permission to enroll that number.

Gift cards
- Gift cards can be used toward objects on theivykeep.com. They do not expire, and there are no fees.
- Gift cards cannot be exchanged for cash, except where the law requires it, and cannot be used to buy other gift cards.
- Anything not spent stays on the card. You can check the balance at any time using the link in the gift card email.
- Please keep the code safe: anyone who has it can spend the balance. If a card is lost or stolen, contact us and we can replace the code for any balance not yet spent.
- If an order paid with a gift card is refunded, the gift card part is returned to the card.
Product information
We make reasonable efforts to describe and photograph our objects accurately.
Because many Ivy Keep objects include paper, wood, metal, textiles, printed materials, or other physical components, minor variations in color, texture, finish, placement, or appearance may occur. Colors may also appear differently depending on your screen or device.
Such minor variations do not necessarily indicate that an object is defective.
Availability
Objects may be offered in limited quantities. Placing an object in your cart or Kept Objects does not reserve it or guarantee its availability.
If an object becomes unavailable after you place an order and we are unable to fulfill that portion of your order, we will contact you and issue any applicable refund.
Intellectual property
Content on the Site, including text, photographs, illustrations, designs, graphics, logos, product names, and other original material, belongs to The Ivy Keep or its licensors and may be protected by copyright, trademark, and other applicable laws.
You may not reproduce, distribute, modify, sell, or use Site content for commercial purposes without our prior written permission, except as permitted by law.
Acceptable use
You agree not to misuse the Site.
This includes attempting to gain unauthorized access to the Site or another person's account; interfering with the Site's security or operation; submitting false or fraudulent information; using automated systems to place orders or abuse Site functions; or using the Site for unlawful purposes.
Disclaimer
The Site is provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.
We do not guarantee that the Site will always be available, uninterrupted, or free from errors.
Nothing in these Terms excludes warranties, protections, or other rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by applicable law, The Ivy Keep will not be liable for indirect, incidental, special, or consequential damages arising from use of the Site or purchases made through it.
To the fullest extent permitted by law, our total liability for a claim relating to an order will not exceed the amount paid for that order.
Nothing in these Terms limits or excludes liability or consumer rights that cannot legally be limited or excluded.
Indemnification
To the extent permitted by law, you agree to indemnify and hold The Ivy Keep harmless from claims, losses, or expenses arising from your unlawful misuse of the Site or material breach of these Terms.
Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles.
Subject to any rights or remedies available to you under applicable law, disputes relating to these Terms or the Site will be brought in the appropriate state or federal courts serving Gwinnett County, Georgia.
Changes to these Terms
We may update these Terms from time to time.
The version in effect when you place an order will apply to that order. The effective date at the top of this page indicates when these Terms were last updated.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
